Court Declares Invasion of Nnamdi Kanu's Lawyer's House Illegal, Awards N100milliom Against Nigerian Army, DSS



A Federal High Court in Awka, Anambra State, has ruled that the invasion of Ifeanyi Ejiofor's home by the Nigerian Army, the Department of State Services (DSS), and the Nigerian police by the arrested leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, was illegal and unconstitutional.

The court also awarded the security agencies engaged in the invasion N100 million in aggravated damages.

Recall that four people, including two Indigenous People of Biafra members and two police officers, were slain in Oraifite, Ekwusigo Local Government Area, Anambra State, after a mixed squad of military and policemen attacked Ejiofor's home.


While delivering his judgment in a fundamental rights enforcement suit marked FHC/AWK/CS/56/2021, the presiding judge, Justice H. A. Nganjiwa, declared that the brutal invasion of the lawyer's ancestral home on June 6, 2021, was oppressive, illegal, and a gross violation of his rights to life, dignity of human person, fair hearing, and right to private and family life.

The court further ordered the Nigerian Army, DSS, Nigerian police, Nigeria Security and Civil Defence Corps (NSCDC), and others to pay the lawyer N100 million in restitution.

The court also declared unconstitutional and unlawful the seizure and subsequent burning of Ejiofor's Toyota car with registration number YAB 60 CB, as well as the dead body of Mr. Samuel Okoro and other crucial documents and valuables confiscated by security officers from the lawyer's house.

Nganjiwa also issued an injunction prohibiting the Nigerian government and security officials from harassing, threatening, or otherwise attempting to end the applicant's life.

The court also ordered the Inspector-General of Police, the Chief of Army Staff, and the Director General of the Department of State Services (DSS) to quickly identify and discipline any individuals implicated in the heinous act.

The Nigeria Police Force, the Inspector-General of Police, the Department of State Service, the Nigerian Security and Civil Defence Corps (NSCDC), the Nigerian Army, and the Chief of Amy Staff are among the defendants in the case.
